Terms of Use
These Terms of Use ("Terms") govern your access to and use of Jummall's website at jummall.comand our mobile applications for Android and iOS (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
Jummall is an online marketplace that connects buyers with verified Nigerian vendors. We provide the platform, escrow payment protection, and dispute resolution. Vendors — not Jummall — are the sellers of products listed on the marketplace.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Nigerian law to use the Service. By using Jummall you confirm that you meet these requirements.
3. Your account
- You are responsible for keeping your login credentials confidential.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate information and to keep it updated.
- You may not create more than one account or impersonate another person.
- We may suspend or terminate your account if you violate these Terms or applicable law.
4. Buying on Jummall
- Product listings, descriptions, and prices are provided by vendors. Jummall is not responsible for the accuracy of listings.
- Orders are subject to vendor acceptance and stock availability.
- Payments are held in escrow until you confirm delivery of your order. Funds are released to the vendor only when you confirm receipt using your 6-digit release code.
- If the vendor cancels or fails to ship, your funds are automatically refunded.
- You may return eligible items within 7 days of delivery, in accordance with our Returns Policy.
5. Selling on Jummall
- To sell, you must complete vendor verification and agree to the Seller Agreement.
- You are responsible for the accuracy of your listings, the quality of your products, and timely fulfilment.
- You agree not to list prohibited items (counterfeit goods, illegal substances, weapons, hazardous materials, items that infringe intellectual-property rights, or anything restricted by Nigerian law).
- Jummall charges a commission on each completed sale, disclosed in the Seller Agreement.
- You authorise Jummall to hold payment in escrow on your behalf until the buyer confirms delivery.
6. User content
You retain ownership of content you post (product photos, reviews, etc.), but grant Jummall a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content for the purpose of operating and promoting the Service. You represent that you own or have the necessary rights to the content you post.
7. Prohibited conduct
You agree not to:
- Use the Service for any unlawful purpose.
- Harass, abuse, or harm other users.
- Post false, misleading, or fraudulent content.
- Attempt to bypass escrow or settle transactions off-platform.
- Scrape, reverse-engineer, or interfere with the Service.
- Upload viruses, malware, or other malicious code.
- Infringe the intellectual-property rights of others.
8. Intellectual property
The Jummall name, logo, designs, and all related content (excluding vendor and user content) are the property of Jummall and protected by copyright, trademark, and other laws. You may not use them without our prior written permission.
9. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied. Jummall does not warrant the quality, safety, legality, or accuracy of any vendor listing. Your transactions are between you and the vendor; Jummall provides the platform and escrow service.
10. Limitation of liability
To the maximum extent permitted by law, Jummall will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid to Jummall in the 12 months preceding the claim, or ₦100,000, whichever is greater.
11. Indemnification
You agree to indemnify and hold Jummall harmless from any claims, losses, or damages arising from your breach of these Terms, your violation of any law, or your infringement of any third-party rights.
12. Dispute resolution
For order disputes between buyer and vendor, our internal dispute-resolution process applies; we aim to resolve disputes within 24 hours. For disputes between you and Jummall, the parties agree to first attempt good-faith negotiation. Unresolved disputes will be settled by the courts of Lagos State, Nigeria, applying Nigerian law.
13. Termination
You may stop using the Service at any time and delete your account via our Account Deletion page. We may suspend or terminate your access for any violation of these Terms or applicable law. On termination, sections relating to liability, indemnification, intellectual property, and dispute resolution survive.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service prior to the change taking effect. Your continued use after the effective date constitutes acceptance of the updated Terms.
